Learned APP under instructions informs that Section 313 IPC has been added during the pendency of these proceedings consequent to medical opinion received.

Learned counsel for the petitioner prays that he may be permitted to withdraw the petition with liberty to file a fresh petition seeking bail inter-alia under Section 313 IPC. He prays that the interim protection granted to the petitioner be extended by a period of 10 days to enable him to file an appropriate application before the competent Court.

In view of the above, petition is dismissed as withdrawn. BAIL APPLN. 372/2018

The interim protection granted to the petitioner is extended by a period of 10 days to enable the petitioner to apply to the competent Court.

It is clarified that on an application being made within a period of 10 days and being considered by the Court, the interim protection shall automatically lapse. It is further clarified that the application if moved shall be considered by the Court on its own merit without being influenced by anything stated in this order. 6.
