This petition has been filed alleging wilful disobedience of orders dated 30th July 2021 and 13th August 2021 passed in Cont. Case No.286/2020, in the background of order dated 15th October 2018 in W.P.(C) 940/2016.

The issue concerns the petitioner, who is a medical doctor posted with Sashastra Seema Bal (SSB) currently at Headquarters, Delhi, and has been seeking relief against transfer to a non-combatized organization with a civil cadre. His request was accepted by the Central Administrative Tribunal, which was challenged by respondent before this Court in W.P.(C) 940/2016, wherein orders were passed with directions to transfer petitioner to a civil post within 8 weeks.

Petitioner claims to have been excluded despite many colleagues having been transferred to civil departments. The issue is pending before this Court in Cont. Case No.286/2020, which is currently listed for 17th September 2025.

Mr. Viraj R. Datar, senior counsel appearing for petitioner, states that the current concern arises from the office order dated 04th February 2025, wherein orders were issued for petitioner to serve for Review Medical Exams (RME) in combatant sites.

However, Ms. Avshreya Pratap Singh Rudy, counsel appearing for respondents, states on instructions that this is just a temporary assignment and not a posting; petitioner will continue to be posted at the Headquarters. 6.
As regards the other contempt petition, they shall duly inform the Court of their instructions as regards the larger issue of which the petitioner is aggrieved with, as and when the matter comes up on 17th September 2025. 7.
Accordingly, petition is disposed of with the aforesaid observations. 8.
Pending applications, if any, also stand disposed of. 9.
