% 15.11.2019 The petitioner has preferred the present writ petition to seek the following reliefs:
"a) Issue a writ of Mandamus or any other suitable writ, order or direction in the like nature thereby holding that the acquisition proceedings resulting from the Khasra bearing No. 80 (04-02) Award No. 11/1992-93 dated 19.06.1992 and all subsequent proceedings under Land Acquisition Act in respect of land of Khasra No. 80 (04-02) l/12th share i.e. (0-7) situated in the revenue estate of village Khajuri Khas, Shahdara, Delhi is null, void and all subsequent proceedings conducted. b) Direct the respondents to release the aforesaid land
comprised in Khasra No. 80 (04-02) l/12th share i.e. (0-7) situated in the revenue estate of village Khajuri Khas, Shahdara, Delhi.
c) Pass such other or further orders, as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." The acquisition in the present case was initiated in the year 1989 under the Land Acquisition Act with the issuance of notification under Section 4 of the said Act; the notification under Section 6 of the said Act was issued on 20.06.1990 and; the award was made on 19.06.1992. The present petition has been preferred only now on the basis of enactment of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The petition is barred by delay and latches and there is no explanation furnished in the writ petition to explain the immense delay in preferring the same. In view of the aforesaid, learned counsel for the petitioner seeks leave to withdraw the present writ petition with liberty to file afresh with adequate justification for the delay in preferring the petition.
