% 02.05.2018 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.391/17 under Section 376 IPC registered at Police Station Nabi Karim. Status report is on record. (2) I have heard the learned counsel for the parties and have examined the file. By an order dated 08.03.2018, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation.
(3) On the previous date of hearing, the complainant's counsel was permitted to file response to the bail application. However, none has BAIL APPLN. 379/2018
appeared on behalf of the complainant today.
(4) Status report reveals that the parties were acquainted with each other since long. Physical relations took place between the two on several occasions on the alleged promise to marry. When marriage did not happen, the FIR in question has been lodged. (5) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the conditions that he shall join the investigation as and when required and shall not contact the prosecutrix and criminally intimidate her in any manner, whatsoever. (6) The bail application stands disposed of.
