O R D E R

The petitioner has filed the present application seeking interim bail in regard to FIR No. 0249/2017 under Sections 302/307 of the IPC and Sections 25/27/54/59 of the Arms Act, 1959 registered with PS South Rohini.

The petitioner has sought the aforesaid bail on an interim basis on the ground that his wife is required to undergo a surgery on account of excessive bleeding. He also states that the marriage of his sister-in-law is scheduled to be solemnised on 16.11.2019. The fact that the petitioner's wife is ailing has been verified.

Although, it is stated that she may not require any surgery and may be provided conservative treatment, it is also clarified that she was advised surgery on earlier occasions. However, she was treated with blood

coagulating medicines and since there was some recovery from such treatment, her surgery had been postponed and she had been discharged on 08.11.2019. She had been advised regular follow up. 4.

The learned counsel appearing for the petitioner, however, states that her surgery is scheduled for 15.11.2019. He has also produced documents supporting the aforesaid contention.

It is also pointed out that the petitioner has been granted interim bail on four other occasions and he had not misused the same. In view of the above, the present petition is allowed and the petitioner is directed to be released on bail for a period of two weeks from the date of his release, on his furnishing a personal bond in the sum of ₹20,000/- and a surety of an equivalent amount to the satisfaction of the concerned trial court. The petitioner shall not leave the National Capital Territory of Delhi. The petitioner shall also provide his mobile number, on which he shall be reachable at all times.

The petition is allowed in the aforesaid terms. 7.
