This public interest litigation has been filed seeking a direction to the respondent No.2/GNCT of Delhi to constitute the 5th Delhi Finance Commission in terms of the constitutional requirements. Certain other directions are also sought regarding the allocation of funds. 2.

Sh.Rahul Mehra, the learned Sr.Standing Counsel for the GNCTD on instructions submitted that the Cabinet of the Delhi Government has approved the constitution of the 5th Finance Commission for Govt. of NCT of Delhi and the matter is now pending before the Lieutenant Governor. He also submits that the necessary order constituting the Commission will be passed as and when the approval is received.

In the circumstances, it appears to us that the writ petition is premature.
