% 01.03.2016 After some hearing learned counsel for the appellant sought liberty to withdraw the appeal and stated that the variation of interest for the period in which the excess payment was made in 2007 may be granted and an application in that regard would be moved before the learned Single Judge. If such application is moved, the learned Single Judge may decide it appropriately in accordance with law and in the circumstances of the case.

The appeal along with pending applications is dismissed as withdrawn.
