% 30.07.2018 After some arguments, learned counsel for the plaintiff wishes to withdraw the present suit with liberty to file an appropriate application in CS (OS) 2053/2008.

With the aforesaid liberty, present suit and pending applications are dismissed as withdrawn. However, it is clarified that the rights and contentions of all parties are left open and this Court has not expressed any opinion either on the merits of the controversy or on the maintainability of the application.
