The present application has been filed by petitioner for enlargement of time granted to the learned Trial Court for deciding the appeal for a further period of three months.

Learned counsel submits that vide order dated 08.01.2024, CM(M) 1296/2022 was disposed of whereby learned Trial Court directed to dispose of the appeal within a period of three months w.e.f 08.01.2024. Learned counsel submits that the matter was being heard by learned Trial Court when the respondent filed certain documents on 28.03.2024 for the first time and therefore, the petitioner has moved an application under Section 45 of the Indian Evidence Act, 1872 for sending the said documents to CFSL, Delhi. It is submitted that in these circumstances, the period for disposal of appeal be extended to a further period of 3 months.

Submissions have been strongly opposed on behalf of the respondents submitting that the arguments on the application under Section 45 of the Evidence At has already been heard and the matter is listed before the learned Trial Court for disposal of the application as well as of the main appeal for today.

In these circumstances, no further orders are required to be made in the application. The same stands disposed of.
