The present petition under Section 10 and 12 of the Contempt of Courts Act seeks the following prayers: - "(i). Initiate contempt proceedings against the respondent for his intentional violation of the order dated 25 .01.2011 and direct the respondent to be present in the court in the interest of justice. (ii) Direct the respondent to comply with the order dated 25.01.2011.
(iii) Pass such order or any further orders as this Hon'ble Court may deem fit and proper, in the interest of justice." 3.
Learned counsel appearing on behalf of the petitioner submits that during the pendency of the present petition the respondent has since passed away.

In view of the same, the present petition has become infructuous and he seeks leave to withdraw the present petition. 5.
Leave granted.
