Through the present writ petition, the Petitioner prays for the following reliefs:

"a) Praying therein for kindly granting the Writ of Certiorari and (or) any other Writ, Direction, Order this Hon'ble Court deems fit & proper under the facts and circumstances of the present case, by quashing the Order dt. 08.06.2023 passed by the Ld. ADG, CISF and/ or remanding the matter back to the Ld. ADG, CISF for reconsideration of the Revision Petition on merits, as not being time barred;

b) Praying for kindly granting a Writ of Mandamus and/ or any other Writ, Direction or Order of this Hon'ble Court directing the Respondent to provide a copy of the Enquiry Report to the Petitioner;

c) Praying to grant any other relief as deem fit and proper under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

d) The Petition may kindly be allowed in favour of the Petitioner with costs."

The revision petition filed by the Petitioner against the order passed on 04.09.2021 which was affirmed in appeal by the Appellate authority on 28.01.2022 has been dismissed on the ground that the Petitioner has not submitted any documents in support of his claim for condoning the delay of nearly three months in filing the revision petition.

Though the Petitioner did not file any separate application for condonation of delay, however, in the memorandum of revision petition, he had disclosed the following reasons: "(i) I have been infected Covid-19 in twice resulted suffering from pre-covid-19 diseases like bad health condition for long period with slightly loss of memory.

(ii) I have been continuously transferred from ASG Bangalore to ASG-Mangalore to NCL-Singrauli with in short period due to in which could not be able to remember the last date for preferring revision petition.

(iii) My parents were suffering from all old age illness due to in which I am suffering from mental stress resulted forgot to last date for preparing revision petition."

From a reading of the order passed by the Revisional authority, it is apparent that the order does not examine the grounds or explanation furnished by the Petitioner while seeking condonation of delay.

The revisional authority is expected to examine the ground or the explanation given by the Petitioner seeking condonation of delay. 8.

Keeping in view the aforesaid position, the order passed on 08.06.2023 by the Revisional authority (Additional Director General/ AS) is set aside while requesting the authority to pass a fresh order after taking into account the reasons/ explanation furnished by the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Let appropriate order be passed by the authority within the next three months.
