The suit had been filed against defendant nos. 1 and 2 restraining them from passing off, infringement, and rendition of accounts. As per order dated 18th January, 2024, the suit was decreed in favour of plaintiff with respect to defendant no.2 in terms of compromise recorded in the settlement agreement dated 4th January, 2024.

As regards defendant no.1, it is noted that defendant no.1 has not been appearing in the matter since July 2023. Accordingly, counsel for plaintiff prays for a decree in their favour qua defendant no.1 as well in terms of prayer in paras 31(a) and (b) of the plaint.

The Court has perused the documents on record as well as averments in the plaint. Considering that the same are unrebutted by defendant no.1, plaintiff is entitled to a decree in their favour. 4.
Accordingly, decree sheet be prepared in terms of prayers as noted above.
