Petitioner is plaintiff before the learned Trial Court and is pursuing a suit for injunction and possession.

When the case was at the stage of defendant's evidence, learned Trial Court permitted the defendant to place on record certain documents, including a pen drive, in order to show his possession. 3.
Such application moved by the defendant No.1 under Order VIII Rule 1A CPC has been allowed by the learned Trial Court vide order dated 11.03.2025.

Such order is under challenge.

However, during course of the arguments, learned counsel for petitioner/plaintiff submitted that since the plaintiff is also interested in expeditious disposal of his suit, without prejudice to his rights and contentions, he does not press the present petition but seeks a direction that on account of such belated filing of documents, the plaintiff may be given a right CM(M) 1232/2025 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. to lead evidence in rebuttal, if so required. 6.
None appears on behalf of the defendants/respondents despite advance notice.

In view of the above, the present petition is disposed of as not pressed and, simultaneously, on account of belated filing of the documents in question, the plaintiff is given right to lead evidence in rebuttal, limited to the abovesaid documents only.

Pending applications also stand disposed of in aforesaid terms.
