O R D E R

This order is in pursuance of the earlier order dated 14th January, 2019.

After deliberations, with the consent of the parties through counsels, the following consent decree is passed in the suits:- A.

A decree is passed in favour of the plaintiff in CS(OS) No.357/2018 and against the defendants in the said suit, of recovery of Rs.63,00,000/- with interest at 9% per annum with effect from six months after the expiry hereof till the date of payment, together with costs of the suit, with professional fee assessed at Rs.1,00,000/-. However if the defendants in CS(OS) No.357/2018, on or before 11th March, 2019, pay a sum of CS(OS) 85/2016 & CS(OS) 357/2018

Rs.57,50,000/- to the plaintiff in CS(OS) No.357/2018, the entire decretal amount shall stand satisfied and the defendant shall stand absolved of the decree for the remaining amount. B.

CS(OS) No.85/2016 is dismissed.

C.

The parties are left to bear their own costs. Decree sheets be drawn up.
