MAT.APP.(F.C.) 237/2024 1.

The present Appeal, under Section 19 of the Family Courts Act, 1984, has been filed by the Appellant/Wife against the Impugned Order dated 26.02.2024 passed by the learned Judge, Family Courts, Karkardooma Courts, Delhi, in HMA 1116/2021 titled as "Gagandeep Singh @ Shankey v. Bavleen Kaur @ Simpi", vide which the learned Single Judge has dismissed the Application of the Appellant under Sections 24 and 26 of the Hindu Marriage Act, 1955. 2.

After some arguments, learned counsel for the Appellant/Wife prays for leave to withdraw the present Appeal and file an appropriate application before the learned Family Court, as permissible under law, in order to expedite the proceedings before the learned Family Court. 3.

Leave and liberty granted.

Accordingly, the present Appeal, along with pending application(s), if any, stands dismissed as withdrawn. 5.

If there is any change in the circumstances, the Appellant may, if so required, file a fresh application under Section 24 of the Hindu Marriage Act, 1955, for the grant of pendente lite maintenance. CONT.CAS(C) 1699/2024 6.

It is pertinent to mention here that vide Order dated 25.09.2024, during the hearing of the present matter, it was observed by the learned Predecessor Bench that the Appellant/Contemnor herein, Sh. Gagandeep Singh, in MAT.APP.(F.C.) 229/2024 was behaving in the most unacceptable manner and was repeatedly interfering his counsel as well, which prima facie appeared to be contemptuous. proceedings the matter was passed over, to enable learned counsel for the Contemnor to obtain instructions and when the matter was taken up after a pass-over, learned counsel for the Contemnor prayed for and was granted one week's time to file the Contemnor's affidavit apologising for his behaviour in Court as also undertaking not to post any information or derogatory comments on any social media platforms in respect of his estranged wife, daughter, or her family members or to send any messages to them on their personal mobile or e-mail.

However, vide order dated 28.10.2024, the Respondent in MAT.APP.(F.C.) 229/2024 had relied upon and tendered copies of two sets of chats comprising 18 pages to bring the fact before the learned Predecessor Bench that the Contemnor was still behaving in a contemptuous manner in violation of Order dated 25.09.2024, which had resulted into the initiation of contempt proceedings against him. 8.

Accordingly, this Court vide Order dated 09.10.2024 initiated suo moto proceedings against Sh. Gagandeep Singh/Contemnor for having committed Contempt of Court.

The Contemnor has been examined by the Institute of Human Behaviour and Allied Sciences on 06.02.2025 and report of the concerned institute reads as under:- "In compliance with the Hon'ble High Court's order dated 20.01.2025, it is most respectfully submitted that the aforesaid patient visited IHBAS for the first time in the Emergency department on 11.12.2024, with the High Court order dated 25.11.2024, was registered with CRF No.20240133218. An initial assessment was conducted in the emergency department, where the need for admission was observed in view of detailed assessment. Both the patient and the father refused admission & gave negative consent for the same requested to continue follow up on outpatient basis. Patient was subsequently admitted in IHBAS on 25.01.2025 under Section-85/86 of Mental Healthcare Act, 2017. Standing Medical Board was conducted on 06.02.2025 and patient was subsequently discharged on 10.02.2025 and was advised to follow-up in psychiatry OPD. Patient followed up in OPD on 30.05.2025, 19.06.2025, 24.06.2025. Patient reported alone on his last follow-up which was on 01.08.2025 and reported no fresh complaints."

Furthermore, the Appeal being MAT.APP.(F.C.) 229/2024, filed by the Husband/Contemnor was dismissed as withdrawn vide Order dated 08.08.2025, and the Appeal being MAT.APP.(F.C.) 237/2024, filed by the Wife, has been dismissed as withdrawn today vide this Order.

In view of the aforesaid facts and circumstances, this Court is of the opinion that, in order to close the matter, the contempt proceedings against the Contemnor should be dropped.

The present contempt case, along with pending application(s), if any, stands disposed of in the aforesaid terms. 13.
