The present Appeal has been filed by the Appellant (Respondent‟s wife) assailing an order dated 16.03.2024 passed by the Family Court, wherein an application filed by the Appellant under Section 24 of the Hindu Marriage Act, 1955 [hereinafter referred to as „HMA‟] for grant of maintenance pendent lite was partly allowed by the Family Court. It has been observed by the Family Court that the Appellant-wife is highly educated and that she was previously earning regular income while working in M/s Jagbros Consultants Ltd., which is owned by the Respondent-husband.

After some arguments, learned counsel representing the parties are ad idem that the Family Court should be requested to decide the application afresh filed by the Appellant under Section 24 of the HMA, after The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. considering all aspects of the matter.

The proceedings under the HMA are still pending before the Family Court. Accordingly, the Family Court is requested to decide the application filed by the Appellant under Section 24 of the HMA afresh within a period of three months. The Family Court shall decide the application uninfluenced by the previous order, which is impugned herein. 4.

The present Appeal is accordingly disposed of with the aforegoing directions. The pending application also stands closed. ANIL KSHETARPAL, J.
