Two Petitions under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 ("BNSS") have been filed on behalf of the Petitioners for quashing of FIR No.0049/2017 under Sections 498A/406/34 IPC, registered The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. at PS: Nanakpura, Delhi and all consequential proceedings emanating therefrom including Summoning Order dated 13.02.2020. 2.
Learned APP for the State submits that Chargesheet has been filed way back on 13.02.2020 and the matter is at the stage of arguments on Charge. Quashing has been sought on the ground that it is essentially a Civil dispute related to partition, for which a Civil Suit is already pending. No offence, whatsoever, is made out from the averments made in the Petitions. 3.
Essentially, the quashing of FIR has been sought on merits, which can very-well be addressed before the learned Trial Court, at the time of arguments on Charge. It is not a case where extra-ordinary jurisdiction under Section 482 Cr.P.C. needs to be exercised.

Both Petitions along with pending Applications are disposed of with liberty to the Petitioner to raise their contentions before the learned Trial Court.
