These are writ petitions filed under Article 226 of the Constitution of India seeking the following prayers:- W.P.(C) 11955/2019 "(a) Issue appropriate writ, order or direction, directing the Respondent No. 1 to Initiate action In terms of section 24(4) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
of The Delhi School Education Act, 1973 In terms of order dated 28.08.2019;
(b) Issue appropriate writ, order or direction, to the Respondent No. 1 to take over the management of the Schools in terms of Section 20 of the Delhi School Education Act, 1973, read with Rule 50 (xviii) of the Delhi Schools Education Rules, 1973;
(c) Allow the present Petition with cost;..." W.P.(C) 11969/2019 "(a) issue appropriate writ, order or direction, directing the Respondent No.1 to conduct an inquiry into the conduct of the Respondent No.2 & 3 along with Ms. Tara Walwekar and Sh.
K.S.
Upadyay, particularly the aspect of the modifications between the first order dated 02.04.2018 and final order dated 28.08.2019, passed by the Respondent No.3;
(b) Issue appropriate writ, order or direction, directing the Respondent Nos.2 &. 3, to conduct an enquiry into - - Account verification of the vendors for uniforms authorized by the Respondent No.4 School in the years 2013, 2014, 2015, 2016, 2017 and enquiry into their nexus with the Respondent No.4 School.
- Account verification of the vendors for books and stationery authorized by the Respondent No.4 School in 2015, 2016, 2017 and enquiry into their nexus with the Respondent No.4 School.

(c) Issue appropriate writ, order or direction, directing the Respondent Nos.2 & 3, to conduct an enquiry into the Respondent No.5 and its dealings;
(d) Issue appropriate writ, order or direction, directing the Respondent No.2 to conduct an enquiry as to why the Respondent No.4 School uniform was changed in 2016 and again in 2017 and the monetary benefit accrued to the Respondent No.4 School due to the same;
(e) Issue appropriate writ, order or direction, directing the Respondent No. 2 to conduct complete financial audit of the Respondent No. 4 School, inter-alia, by the Comptroller and Auditor General of India, and take necessary action pursuant thereto;
(f) direct the Respondent No.4 School to refund the entire amount charged in excess from the parents, including the development fee, building fund, etc. along with interest @18% per annum;
(g) direct the Respondent No.4 School that 'annual charges' and 'miscellaneous charges', charged by It be refunded or adjusted in future installments of the fee, along with interest @18% per annum;
(h) issue appropriate writ, order or direction, directing the Respondent No.4 School, to implement the comprehensive report dated 02.04.2018 in its letter and spirit; (i) Allow the present Petition with cost;..." 2.

Mr. Sharma, learned counsel appearing on behalf of DoE, to act as a mediator and try to arrive at a settlement with the parties as well as the respondent school.

With his good offices, the matter has been settled. 4.
Without prejudice to the rights of the parties, it has been decided that the respondent school shall pay a sum of Rs. 1.25 lakhs to Mr. Harman Singh Sikka and a sum of Rs. 1.35 lakhs to Mr. Abhaas Gupta, within one week from today.

The said amounts are paid not due to any admission of liability or that the fee charged by the respondent school was illegal and unauthorized, but only to put a quietus to the matters, which have been pending adjudication in this Court for last more than 5 years. 6.
The order has been passed in the peculiar fact of the present case and is not to be treated as a precedent. The payment is not to be treated as a precedent and no rights are accrued to the petitioners. 7.
In case the amounts are not paid, they shall carry interest @ 12% p.a. 8.
With these directions, the present petitions are disposed of, along with pending applications, if any.
