O R D E R

The present petition is filed under sections 11 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India, seeking initiation of contempt proceedings against Respondent No. 1 for wilful disobedience of the order dated 25.09.2023, passed by this Court in Crl.Rev.Pet. No. 920/2023 2.

The respondent, who appears in person through video conferencing, states that he does not want the services of his lawyer. Mr. Ankur Kashyap, learned counsel, is discharged from the case.

The learned counsel for the petitioner submits that the respondent is in contempt of the said order inasmuch as the undertaking given by the Respondent No. 1, that he would abide by the directions of the learned Family Court, has not been complied with and the monthly expenses have not been paid. The respondent disputes the said fact.

It is noted that this Court has not impeded the learned Trial Court from passing any order in case any application for execution of the order is filed.

In such scenario, this Court considers it apposite not to keep the present petition (CONT.CAS(C) 1621/2023) pending. The petitioner is at liberty to file an appropriate application before the learned Trial Court for execution of the order dated 01.07.2023.

As and when such application is filed, the learned Trial Court is directed to proceed with the application without being influenced by the pendency of the Crl. Rev. Pet. No. 920/2023. 8.

The present petition, along with the pending applications, is disposed of in the aforesaid terms.
