Counsel for the plaintiff submits that there is an oral agreement between the plaintiff and the defendants in terms of which the defendants have agreed to execute a sale deed in favour of the plaintiff in respect of the suit property within six (6) months from today.

In view thereof, the counsel for the plaintiff seeks to withdraw the present suit with leave to file a fresh suit in the event the defendants fail to fulfil the aforesaid commitment.

Since the suit has been settled between the parties at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870.
