% 09.03.2017 The parties have sorted out the matter.
Learned counsel for the petitioner submits that the petitioner will vacate the tenanted property and hand over vacant physical possession of the same to the respondent on or before 07.05.2018. Let the petitioner file an affidavit undertaking to vacate the suit property being one shop in the property bearing No. 2554 situated at Ground Floor, Jain Stanak Road, Tri Nagar, Delhi and to hand over vacant physical possession of the same to the respondent on or before 07.05.2018. In the affidavit an undertaking will also be given by the petitioner to pay the agreed rate of rent @ Rs.325/- per month. Arrears of rent shall be paid within two months from today. Future rent will be paid by the 7th day of each month. The petitioner will also undertake to pay water and electricity
dues for the period of his occupation. The petitioner will also undertake not to induct any third party in the tenanted property or cause wilful damage to the property.
The undertaking by way of affidavit shall be filed within two weeks. The learned counsel for the petitioner submits that in view of the above undertaking, he does not want to press the present petition. The learned counsel for the respondent submits that in case the petitioner files the affidavit within two weeks, the respondent will not execute the eviction order till 07.05.2018.
Keeping in view the above, the present petition is disposed of. All pending applications also stand disposed of.
