Learned counsel for the petitioner submits that the respondent has included the petitioner's name in the draw of lots held on 29th November, 2016 in which flat bearing No.32, Second Floor, Sector - 17, Pocket D, MIG, Dwarka was allotted to the petitioner.

The intimation of the fresh allotment was given to the petitioner vide letter dated 6th January, 2017, copy whereof has been handed over and taken on record. It is further submitted that the respondent issued a demand letter pursuant to the allotment of the aforesaid flat to the petitioner. 2.

Learned counsel for the petitioner submits that the petitioner has filed a separate writ petition bearing W.P.(C) No.6650/2017 to challenge the demand raised by the respondent in which notice has been issued and the writ petition is listed on 16th November, 2017. 3.

This writ petition does not survive anymore in view of the fresh allotment made by the respondent to the petitioner and the same being subject matter of a writ petition being filed by the petitioner.

This petition is disposed of. The parties are at liberty to urge their respective contentions in the fresh writ petition filed by the petitioner. 5.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
