There are two aspects which are argued before this Court on behalf of the petitioner. First aspect is grant of facilities to the petitioner as are necessarily to be provided to a telephone operator, and which facilities petitioner claims are not being given to her, and the second aspect being of consideration of promotion of the petitioner from a Telephone Operator to a Senior Grade Telephone Operator/Monitor.

So far as the first aspect of grant of facilities to the petitioner as

are given to a telephone operator, counsel for the respondents states that respondents under a written intimation will inform the petitioner of the facilities which are ordinarily available to a telephone operator and what are those specific facilities which have been provided to the petitioner, and if any further facilities are to be provided which are provided to other telephone operators such as the petitioner, the respondents will provide the same. Needful be done by the respondents within a period of four weeks from today.

So far as the second aspect of grant of promotion is concerned, the issue of consideration of promotion can only be if petitioner satisfies the eligibility criteria for promotion to the higher post of Senior Grade Telephone Operator/Monitor. It is seen that though there may not be specific promotion/recruitment rules for a Senior Grade Telephone Operator/Monitor, but the eligibility criteria would be prescribed as regards the group of posts being Group-C post of the petitioner as stated by the petitioner, and the higher Group-B post i.e there may not be any specific recruitment/promotion rules for a telephone operator, but there would be recruitment/promotion rules for a group of posts which include the post of

telephone operator and a group of posts which include in it the Senior Grade Telephone Operator/Monitor.

At this stage, qua the second aspect counsel for the petitioner states that petitioner would like to examine the issue as to whether at all any issue of promotion is involved or the issue involved is of increase of payscale only, and accordingly, after getting the necessary details, and if petitioner is entitled to a legal right in accordance with law, which petitioner has not been granted then, accordingly a fresh petition containing a complete cause of action for promotion or higher pay-scale will be filed by the petitioner, and liberty for which is granted. 5.
