By way of this appeal filed under Section 374 Cr.P.C., appellant is challenging the judgment dated 12th January, 2015 and order on sentence dated 17th January, 2015 passed by learned ASJ, Shahdara District, Karkardooma Courts, Delhi in Session Case No.01/2014 whereby appellant has been convicted under Section 397 IPC read with Section 25 and 27 of CRL.A. 288/2016

the Arms Act.

Today learned counsel for the appellant submits that appellant has already challenged the above judgment by filing an appeal being Crl.A.217/2016 before this Court and so he may be permitted to withdraw this appeal.

In view of the above, the appeal along with pending application is dismissed as withdrawn.
