The present petition under Section 25-B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers:- "i) set-aside the Order dated 09.04.2025 passed by Ms. Arjinder Kaur Additional Rent Controller-02 (Central) Delhi in Misc RC/ARC No.68/2024 whereby the Ld. Additional Rent Controller has dismissed the application filed by the petitioners for setting aside ex-parte eviction order dated 04.09.2023 in RC/RAC No.403/2023 in case title "Raisuddin vs. Raisa Begum & Ors." Passed by Additional Rent Controller-02 (Central) Delhi and also restore the possession of subject property/shop having measurement 8'x21 on the ground floor bearing No. 778, Ward No. IX, motor Market, Jama Masjid, Delhi-110006; And/or; ii) set-aside ex-parte eviction order dated 04.09.2023 in RC/ RAC No.403/2023 in case title "Raisuddin vs. Raisa Begum & Ors."
passed by Ms. Neetu Nagar, ARC-02, Central District, Tis Hazari Courts, Delhi; iii) Any other appropriate order/direction may also be passed in favour of the petitioner against the respondents which this Hon'ble Court deems fit and proper in the facts and circumstances stated herein above." Learned counsel appearing on behalf of the petitioners seeks leave of this Court to withdraw the present petition, with liberty to initiate appropriate proceedings, in accordance with law, before the Court of competent jurisdiction.
