The present application has been filed under Section 438 Cr.PC. by the applicant seeking anticipatory bail in FIR No. 10059/23 registered under Section 379 IPC at P.S. R.K. Puram, Delhi.

Learned counsel for the applicant submits that applicant's name has come up only in the disclosure statement of co-accused and no other allegations have surfaced either in the FIR or investigation. He further submits that pursuant to the interim protection granted to him, the applicant has joined the investigation.

Mr. Sabharwal, learned APP for the State has opposed the bail application. He has handed over a copy of the Status Report, which is taken on record. Learned APP submits that the applicant is a part of a gang which is involved in stealing cars and selling the same by forging its particulars. cheating and forgery in Sonipat. He however, submits that applicant has joined the investigation.

At this stage, learned counsel for the applicant states that the applicant was last involved in a FIR in the year 2018 and in the present case, his name has been figured only in the disclosure statement of Rupinder, who has already been admitted to anticipatory bail. He further submits that another co-accused Amit Kumar has also been admitted to anticipatory bail. 5.
Considering the aforesaid facts and that the applicant has already joined the investigation, the interim protection granted to the applicant vide order dated 15.12.2023 is made absolute and it is directed that in the event of arrest, the applicant be released on bail subject to him furnishing a personal bond in the sum of ₹25,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial.
(ii) The applicant shall join the investigation as and when, he is asked for. (iii) The applicant shall inform the concerned Investigating Officer about his current residential address.
(iv) In case of change of residential address/contact detail, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO. (v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

(vi) The applicant shall regularly appear before the trial Court as and when the charge sheet is filed.
