The present application has been filed under Section 482 CrPC seeking modification of the order dated 15.04.2024 wherein it has been recorded that the petitioner's counsel seeks to withdraw the present petition with liberty to file fresh bail application before the learned Trial Court after the completion of the complainant's evidence. 2.

Learned counsel for the petitioner submits that the victim Naresh Kumar has been examined and the petitioner does not wish to cross-examine the said witness. Likewise, the complainant Shankar Lal has also been examined and the petitioner does not wish to examine him either. He submits that in view of the statement of the petitioner's counsel recorded in para 2 and 3 of the said order, the petitioner is not able to approach the learned Trial Court for filing fresh bail plea. 4.

In view of the above, it is clarified that since the petitioner does not wish to cross-examine the victim Naresh Kumar, as well as, the complainant, the petitioner shall be at liberty to file his regular bail even at this stage before the learned Trail Court.
