This matter was called out twice and, as there was no appearance on behalf of the petitioner, the matter was renotified for 7th May, 2019.

Mr. Rama Shankar (Mobile No.9811214465), learned counsel appeared for the respondent.

At the close of the day, Mr. Farooqui appears for the petitioner and submits that, as the cause lists reflected the matter as listed for 3 p.m., he was not present when the matter was called out. 4.

I have seen the cause lists and, though, apparently, the note for listing at 3 p.m. is for item 60, rather than item 61, it seems that the manner in which the note of 3 p.m. has been entered on the cause lists is so confusing that anyone who has seen it, is likely to have the impression that item 61 would be taken up at 3 p.m. 5.

The Registry is directed to be more careful while printing the cause lists so as to avoid such confusion.

Needless to say, the litigant cannot suffer for the lapse on the part of the Registry in printing the cause lists. 7.

As such, renotify this matter on 8th March, 2019. 8.

Learned counsel for the petitioner is permitted to communicate, telephonically to Mr Rama Shankar, about the date fixed in the matter for the hearing. The Court Master is also directed to contact Mr. Rama Shankar telephonically and inform him about the change in the next date of hearing.
