At the outset, learned counsel for the petitioner states that he may be permitted to delete prayer (c) in the prayer clause of the writ petition. Ordered accordingly.

This is the second writ petition filed by the petitioner on the same cause of action. Earlier hereto, the petitioner had filed W.P. (C) No.643/2018 for the same relief, which was subsequently withdrawn by him on 23.01.2018, with liberty to file a fresh petition on the same cause of action.

In this petition, the prayer made by the petitioner is for grant of the benefit of the 2nd financial up-gradation under the ACP Scheme w.e.f. 28.09.1999, in the scale of Sub-Inspector/GD and he has claimed consequential benefits including arrears of payment on the basis of OM dated 09.08.1999.

Learned counsel for the respondents has vehemently opposed the present petition on the ground of gross delay and laches. 5.
After addressing arguments for some time, learned counsel for the petitioner seeks leave to withdraw the present petition. Leave, as prayed for, is granted.
