% 27.07.2018 The petitioner seeks bail in FIR No. 259/2018, P.S. Ashok Vihar under sections 392/394/397/411/427/120-B/201/34 IPC. He is accused of dacoity and was caught at the spot of the crime. He is also accused of offences under the Arms Act, 1959. The bail is sought on the ground that a co-accused has already been granted bail. However, the learned counsel for the State submits that not only was the accused caught at the spot of the crime and he was also found in possession of a country made pistol; he was duly identified by the witnesses during trial and otherwise has criminal antecedents in seven other cases of heinous crimes. At this stage, the learned counsel for the petitioner does not press the application for bail and seeks to withdraw it. However, he submits that the trial of the case may be expedited as 14 witnesses are yet to be examined.
The learned counsel for the State submits that every endeavour shall be made to have the same expedited and the evidence recorded by the end of 2018. Let it be so done.
The petition is dismissed as withdrawn.
