This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the learned Sole Arbitrator by a period of 08 months till 20.02.2026.

Disputes having arisen between the parties in relation to Sales Agreement and Service Agreement, lastly renewed on 15.01.2019, Petitioner filed a petition under Section 11(6) of 1996 Act in this Court being O.M.P.(MISC.)(COMM.) 540/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. ARB. P.777/2023 for appointment of Sole Arbitrator, which was allowed on 20.12.2023, appointing a Sole Arbitrator. It is stated in the petition that cross-examination of CW-1 is yet to commence and therefore the mandate, which has expired on 20.06.2025 be extended by 08 months upto 20.02.2026.

Issue notice.

Mr. Sandeep Kumar, learned counsel accepts notice on behalf of the Respondent and on instructions, submits that Respondent has no objection to the extension of mandate of the Arbitrator, however, since the Arbitrator is also required to adjudicate the Counter Claim of the Respondent, mandate be extended by 10 months.

Accordingly, with the consent of the parties, mandate of the Arbitrator is extended by a period of 10 months from 17.07.2025 and period between 21.06.2025 to 16.07.2025 is regularized.

Petition is allowed and disposed of in the aforesaid terms.
