It is brought to the notice of this Court that the suit in question has already been disposed of and the learned counsel for petitioner/plaintiff also submits that the suit has been decreed in-part. 3.

He submits that, as and when, he challenges the decree in question, he would challenge the order which is impugned herein. This, even otherwise, is permissible in terms of Section 105 CPC, which provides that if any such order affects the decision of the case, it may also be set forth Court as a ground of objection in the memorandum of appeal. 4.

Be that as it may, since the suit has already been decreed, the present petition is disposed of as having become infructuous. 5.

Pending applications also stand disposed of.
