% 01.05.2018 Crl.M.A.No.8152/2018 1.

Notice. Learned Additional Standing Counsel for the State accepts notice.

2.

By this application, the petitioner seeks modification of the order dated February 19, 2018 and prays that he be released on parole on his furnishing the personal bond. The reason for seeking release on personal bond is that earlier also the petitioner was released on parole by this Court when his elder brother stood surety for him. However, now his brother is suffering from various ailments and thus he is not in a condition to travel to Delhi from Bihar for furnishing the surety bond. The petitioner thus prays a personal bond.

W.P.(CRL) 521/2018

3.

Considering the nature of allegations against the petitioner, this Court does not think it to be a fit case for directing release of the petitioner on personal bond. Further since the surety of the petitioner, i.e. his elder brother is residing in Siwan, Bihar, he is permitted to furnish surety bond as directed vide order dated 19th February, 2018 i.e. a surety bond in sum of ₹10,000/- to the satisfaction of the learned CMM/Siwan (Bihar) which surety bond would be thereafter transmitted to the Jail Superintendent, Central Jail No.3, Tihar.

4.

Application is disposed of.

5.

Copy of this order be communicated to the petitioner through Superintendent, Central Jail No.3, Tihar.
