W.P. (Crl.) 541/2016 This is a petition under Section 482 of Cr.PC for quashing of the FIR No. 3/2016 dated 15.01.2016 registered at Special Police Unit for women and children, Crime Cell (Women), Nanakpura Police Station, Delhi filed by the petitioner Nos. 1 & 2 who are the father-in-law and mother-in-law of the complainant on merits. On advance notice, Ms. Richa Kapoor, learned Additional Standing Counsel has appeared on behalf of the respondent No. 1/State and Mr. Sunil Mittal, Advocate has appeared for respondent No. 2.
At the outset, learned standing counsel for the State submits that the petition is pre-mature as the investigation is at the initial stage and the petitioners have been asked to join the investigation.
Counsel for the petitioners submits that the petitioners apprehend arrest in this regard.
Learned ASC submits that so far permission has not been obtained to arrest the petitioners. Even otherwise, the petitioners have appropriate remedy available to them in accordance with law. This petition at this stage is pre-mature. That being so, the learned counsel for the petitioners withdraw the same. Same is accordingly dismissed as withdrawn.
