% 15.02.2018 Vide the present petition, the petitioner/institute has prayed for a direction to respondent nos.3 & 4 to grant approval to the faculty list prepared by the petitioner under clause 7 (13) of NCTE Regulations, 2014 expeditiously within a period of seven days to enable the respondent no.2 to examine the same and grant formal recognition for the academic session 2018-19 before the prescribed cut off date of 03.03.2018.
Ms.Monika Arora learned counsel for respondent nos.1 & 2 and Mr.Deepak Thukral learned counsel for respondent nos.3 & 4 appear on advance notice.
Learned counsel for respondent nos.3 & 4, who appears on advance notice submits that he has instructions to submit that though the respondents have received the faculty list prepared by the
petitioner, a decision on the same could not be taken due to paucity of time. He, however, submits that keeping in view the urgency in the matter and the decision dated 20.09.2010 of this Court in W.P.(C)No.6221/2010, he has instructions to state that the respondent nos.3 & 4 would do the needful after examining the faculty list provided by the petitioner within a period of seven days. In view of the fact that respondent nos.1 & 2 have already taken a considered decision, that the cases where applications were submitted before the imposition of ban by the State Government, the same would be considered irrespective of the ban imposed by State of Haryana, it is made clear that the respondent nos.3 & 4, while considering the application of the petitioner would not reject the same on the ground that there is a ban by the State of Haryana on the opening of new institutes.
The present petition is accordingly disposed of alongwith pending application, with a direction, to the respondent nos.3 & 4 to consider the faculty list provided by the petitioner, and if in order approve the same within seven days.
It is further directed that the decision on the application would be expeditiously communicated to the petitioner as well as to respondent nos. 1 & 2, so as to enable the said respondent nos.1 & 2 to process the petitioner's application before the cut off date of 03.03.2018.
