The present writ petition has been filed seeking directions to the respondent no. 1-Municipal Corporation of Delhi ("MCD"), to demolish the illegal and unauthorized construction, being carried out by respondent no. 3, in the premises bearing No. 66-E/3, Munirka Village, South West Delhi110067. 2.

Perusal of the aforesaid Status Report shows that Demolition Order dated 15th September, 2025, has been issued by the MCD and that the requisite action shall be taken in accordance with law. 4.
Learned counsel appearing for the respondent no. 3 appears and submits that the construction undertaken by respondent no. 3, is not an encroachment on public land. Further, the passage, which has been constructed to connect the two properties is on a private street and belongs to the occupants themselves. Moreover, the said private street has been carved out of the private land of the owners/occupants, themselves. 5.
He submits that the construction done by respondent no. 3 is old and occupied, with ground floor having been constructed in the year 1984 and first, second and third floor having been constructed in the year 1998. 6.

He further submits that liberty may be granted to respondent no. 3 to seek his remedies for challenging the Demolition Order passed by the MCD. 8.
Liberty is so granted.

Accordingly, MCD is held liable to take time bound action against the unauthorized construction, existing in the property in question, subject to any order that may be passed in the proceedings initiated by respondent no. 3 challenging the Demolition Order of the MCD. 10.
Noting the aforesaid, no further orders are required to be passed in the present petition.
