% 11.08.2015 IA No. 16479/2015 (under Order 23 Rule 1 and 3 CPC r/w Section 151 CPC) & CS(OS) No. 751/2014 Learned counsel for plaintiff submits that no relief is pressed against the defendant nos.2 to 5 and suit be disposed of as not pressed qua them. Accordingly, suit is disposed of as not pressed qua the defendant nos.2 to 5. Plaintiff and defendant no.1 are husband and wife. They have settled all their disputes amicably in a case under Section 125 of the Code of Criminal Procedure, 1973 in the court of Shri T.S. Kashyap, Principal Judge,

Family Courts, Vishwas Nagar, , Karkardooma Courts, Delhi on the terms and conditions as stipulated in the Settlement Deed dated 15th January, 2015. Plaintiff and defendant no. 1 have settled all their disputes as have been detailed in the Settlement Deed, which has been accepted by the Family Court.

Parties shall remain bound by the terms of Settlement Deed, which has been annexed with this application.

This suit relates to the following properties:- a) Entire third floor (with roof rights) built on plot no. C-61, admeasuring 62.5 sq. yds. forming part of khasra no. 57/31, Village Gharonda Neem Ka Bangar @ Patparganj, in abadi of Janta Garden, Pandav Nagar, Shahdra, Delhi and b) Flat No. 0206, Tower F, Eco City, GH - 03, Sector - 137, Noida, U.P. Terms of settlement qua the suit properties are detailed in paras 4, 5 and 6 of the Settlement Deed dated 15th January, 2015. In terms of the settlement a decree is passed thereby holding that plaintiff shall be exclusive owner of the entire third floor (with roof rights) built on plot no. C-61, admeasuring 62.5 sq. yds. forming part of khasra no. 57/31, Village Gharonda Neem Ka Bangar @ Patparganj, in abadi of Janta Garden, Pandav Nagar, Shahdra, Delhi and Flat No. 0206, Tower F, Eco City, GH - 03, Sector - 137, Noida, U.P.

Plaintiff will be entitled to

approach the concerned authorities/companies for execution of necessary relevant documents so as to perfect her title in respect of the aforesaid properties, in accordance with law.

If any charges are leviable in this regard, the same shall be borne by the plaintiff alone. However, defendant no. 1 will co-operate with the plaintiff if required for execution of any document(s), in this regard.

All other miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J.
