The present petition under Sections 11 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a) Inquire into the commission of Civil Contempt of Court as defined u/s 2(b) of contempt Act by the respondents for making false and wrongful submissions before this Hon'ble Court in CRL.M.C. No- 738/2021 vide order dated- 18.03.2025 and for filing a frivolous and misleading affidavit;
b) Order for punishment of respondents in accordance with section 12 of the Contempt of Courts Act.
c) Pass such other or further orders as this Hon'ble Court may deem just and proper in the facts and circumstances of the case." 3.
Learned counsel appearing on behalf of the petitioner submits that first supplementary agreement has been arrived at between the parties on 27.08.2025. Copy of the same has been handed over in the Court today and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the same has been taken on record. It is further pointed out that as per 'Clause 7' of the said agreement the following has been agreed: - "7.
It is further agreed that the Second party within a period of 10 days from the execution of this agreement, shall also withdraw two petitions Cont. Cas(C) 1041/2025 & 968/2025 filed before the Hon'ble High Court of Delhi at New Delhi. However, the Second Party has a right to revive the proceedings if the mandate of this agreement is not complied by the First Party." 4.
In view of the above, the present petition is dismissed as withdrawn and disposed of with liberty to revive the present petition in case of noncompliance of the conditions mentioned in the aforesaid agreement dated 27.08.2025.
