Petitioner has filed this petition seeking protection from respondents no. 2 - 8, alleging that her mother and stepfather along with other relatives want to get her forcibly married.

Learned ASC accepts notice and submits that in PS Sahpau, District Hathras, UP, parents of petitioner have lodged a complaint that the petitioner is minor in age and has eloped with one Pavan. 3.

Petitioner is present in person in Court, identified by the IO/Insp. Ashwani Kumar of PS Adarsh Nagar.

Learned counsel for petitioner submits that according to Aadhar Card annexed with the petition, date of birth of petitioner is 10.02.2007. However, according to learned ASC, the copy of Aadhar Card sent to him from Hathras reflects her date of birth as of the year 2010, so she is minor in age. I have spoken with the petitioner in Hindi and she states that she does not know any Pavan and is residing in Delhi with her relative. 6.

Security of the life and limb of the petitioner is of paramount importance. In the case registered in Hathras, the petitioner is certainly not an accused. The issue is as to whether the petitioner is minor in age. Learned counsel for petitioner expresses apprehension that the Hathras police may not safely take petitioner to her mother.

After some discussion, learned counsel for petitioner on instructions requests that petitioner be taken immediately to Nirmal Chhaya, from where she may be produced before CWC for verification of her age and subsequent action in accordance with law. Learned ASC affirms this. Petitioner also expresses no objection in this regard.

Therefore, learned ASC is requested to send the petitioner to Nirmal Chhaya in custody of a lady police officer immediately, accompanied with the IO/Insp. Ashwani Kumar. Thereafter, the petitioner shall be produced before CWC for further processing in accordance with law. 9.

Accordingly, as requested the petition stands disposed of. 10.

Copy of this order be given dasti to IO.
