% 25.05.2017 I.A. No.6514/2017 (under Order XXIII Rule 3 of the Code), CS(COMM) 130/2016, I.A. No.2389/2016 (under Order XXXIX Rules 1 & 2 of the Code) & I.A. No.2392/2016 (under Order XXVI Rule 9 of the Code) This is an application filed jointly by the parties duly signed by the parties and supported by the affidavits of authorized representative of the plaintiff company as also the affidavit of defendant No.2 who is a partner of the firm (defendant No.1). Terms of settlement are contained in the aforenoted application which along with the affidavits is collectively marked as Ex P.1. Parties shall be bound by the terms and conditions contained in Ex P.1. Suit of the plaintiff stands decreed in terms of Ex P.1. The settlement had been arrived inter-se the parties before the Delhi High Court Mediation and Conciliation Centre on 19.05.2017 which has fructified into this decree. In terms thereof, the Court Fee is ordered to be returned.
