This hearing has been done through hybrid mode. 2.

The present petition has been filed under Article 226 of the Constitution of India by the Petitioners, who are 49 street vendors in the Delhi Cantonment Board, seeking appropriate directions against the Respondents. 3.

The Petitioners had initially approached the Court on the ground that they were not being permitted to peacefully vend from their vending sites and the Respondents were threatening to dispossess them from the vending sites. 4.

At that stage, vide order dated 7th August, 2025, the statement made on behalf of the Delhi Cantonment Board was taken on record, to the following effect:

"1.

Learned counsel appearing for respondent no.6/Delhi Cantonment Board states that a resolution not to remove the petitioners is already part of the

record, and the same shall be acted upon till further orders."

Thereafter, the Town Vending Committee (hereinafter 'TVC') of the Delhi Cantonment Board has taken decisions from time to time. 6.

The first decision was taken in the 'Minutes of Meeting' dated 15th January, 2026 as per which, it was resolved by the TVC that all vendors, who had at least three challans prior to 27th October, 2023, would be considered by the TVC and would be permitted to participate in the survey. The relevant portion of the said decision is extracted below: "[...] The TVC after lengthy deliberation resolved that vendors who are able to produce at least 03 challans, issued by Delhi Cantonment Board, before the date of commencement of survey i.e. 27.10.2023 shall be considered to be included in the list of street vendors subject to the holding capacity finalized by the TVC. The TVC further directed the Revenue Superintendent to examine the representations of the vendors, as brought out on the agenda site, in the light of the criteria fixed today by this TVC and to submit a report in the next meeting of TVC for consideration and decision. The meeting ended with a vote of thanks to the chair.

The survey of the Delhi Cantonment Board has already been completed. The list of authorized vendors has also been drawn up. All the Petitioners have been issued provisional Certificates of Vending. 8.

Accordingly, the Petitioners shall be allowed to peacefully vend from their respective vending sites.

However, the further grievance of Petitioners now is that the unauthorized street vendors are causing harassment and obstructing the Petitioners from peacefully vending.

Petitioners place reliance on the Minutes of Meeting dated 3rd November 2025. In terms thereof, it was decided as under: "[...] The TVC resolved that the vendors, identified in the survey published on 26.07.2024 and 23.08.2024, will continue to vend in their respective areas as per the terms and conditions of the vending certificate till the next date of meeting. In the meanwhile, the vendors are specifically directed to adhere to the instruction of the police authorities. It is' open for the police authorities to take action along with the Revenue Department of Delhi Cantonment Board against the unauthorized vendors, functional within the territorial limit of Delhi Cantonment, in accordance with law, who have not been identified in the survey published on 26.07.2024 and 23.08.2024.

Once the vending plan is approved and recommended by the TVC, the same shall be placed before the Delhi Cantonment Board for its approval.

It is made clear that in terms of the 'Minutes of meeting' dated 3rd November, 2025, the Delhi Cantonment Board shall take action against any unauthorized street vendors, in cooperation with the Delhi Police. 12.

It shall be ensured that unauthorized street vendors do not vend in the said areas and the authorized street vendors are not disturbed. 13.

With these observations, the present petition is disposed of. All pending applications also stand disposed of.

The next date of hearing before the Court i.e., 31st August, 2026 also stands cancelled.
