This is an application under Section 482 Cr.P.C. filed on behalf of the petitioner seeking condonation of delay in re-filing the present petition. 2.

For the reasons stated in the application, the delay in re-filing the petition is condoned.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave as prayed is granted. The petition is dismissed as withdrawn along with the pending application.

Learned counsel for the petitioner has prayed that the NBW issued against the petitioner may be set aside.

In the first call, the matter was passed over to enable the learned counsel for the petitioner to take instructions from the petitioner with respect to his appearance before the trial court. In the second call, learned counsel for the petitioner has informed that the next date fixed before the Trial Court is 29.01.2020 and the petitioner undertakes to appear before the Trial Court on any date to be fixed by the trial court on 29.01.2020. 5.

Subject to the above undertaking of the petitioner, the NBW issued against the petitioner is stayed.

Copy of this order be given dasti to the learned counsel for the petitioner.
