By way of present bail application, the petitioner/ applicant seeks anticipatory bail in FIR No.323/2022 registered under Sections 323/341/506/34 IPC & Sections 3(1) (s) /3(1) (W)(i) of SC/ST (POA) Act at P.S. Khyala, Delhi.

Learned counsel for the applicant submits that the present case has arisen out of a landlord-tenant dispute and since the chargesheet has been filed, no purpose would be served by sending the petitioner in custody. He further submits that the allegations are vague and general in nature. 3.
Learned APP for the State has opposed the bail application. He submits that in view of the Section 18 of the SC/ST Act, the anticipatory bail application is not maintainable. It is also stated that during the enquiry in the present case, the applicant himself tried to take advantage of a fake SC/ST Act certificate in her own name for which another FIR bearing No.0547/2023 has been registered under Sections 468/471 IPC at P.S. Dwarka South, Delhi.

Considering that the learned counsel for the applicant has failed to make out as to why the provisions of SC/ST Act are not applicable as well as in view of the conduct of the applicant in getting issued a fake SC/ST Certificate for which a separate FIR is also registered, I find no ground to entertain the present application.
