% 03.10.2024 This matter has been listed on office note dated 03.10.2024, informing the court that the service of Non-Bailable Warrants ('NBWs') upon the petitioner, who had failed to surrender upon expiration of his interim bail, is awaited. Though the office note says that notice to the surety has been served through the Investigating Officer ('IO'), Mr. Utkarsh, learned APP appearing for the State submits, that as per his instructions, the surety has also not been served.

The surety was the petitioner's wife; and it appears that both are not available at their last known address.

The IO is not present in court today. Learned APP submits, that as per oral instructions received, the petitioner is not traceable and the surety is also not present.

Mr. Arjun Malik, learned counsel appearing for the petitioner submits, that he was appointed by Delhi High Court Legal Services Committee to represent the petitioner; and that the petitioner has not been in contact with him either.

In the circumstances, let fresh NBWs be issued against the petitioner, returnable for the next date of hearing.

The IO is directed to exercise further efforts to serve the petitioner; and to ensure that the surety is present in court on the next date. 7.
Let a status report be also filed clarifying whether the petitioner had at all complied with the conditions contained in paras 8.3 and 8.4 of order dated 16.08.2024, whereby the petitioner was granted interim bail.

The IO is directed to remain present in court on the next date of hearing.

Re-notify on 14th October 2024.
