during the course of investigation. It is stated that the said driver Santosh Kumar died during the pendency of the proceedings before the court of the Metropolitan Magistrate for which reason the proceedings in the criminal case stood abated against him and accordingly were closed. It is submitted by the learned counsel for the Government of NCT of Delhi, on instructions from SI Nikhil Singh, present with him, that the proceedings in the kalandara against the second respondent were also closed with the order holding the proceedings against the driver to have abated. Since this may not be proper, the facts need to be confirmed from the concerned Metropolitan Magistrate.
A report of the Metropolitan Magistrate, therefore, shall be called through the District and Sessions Judge (North West). Registry to take appropriate steps to ensure that the report is available when this matter is taken up for further hearing on 19.09.2017.
