Learned counsel for petitioner has, very fairly, stated that learned Trial Court has already framed issues on 30.04.2024 and the issues with respect to Territorial Jurisdiction and Privity of Contract have also been framed. He states that in view of the aforesaid, he does not press this application. He, however, prays that this Court may observe that the observations and findings given by learned Trial Court in impugned order dated 19.08.2023 are mere prima facie in nature.

In view of the aforesaid statement, the present petition is dismissed as not pressed.

Needless to say, since the learned Trial Court has already framed specific issues with respect to Territorial Jurisdiction and Privity of Contract, the learned Trial Court would decide those issues in terms of the evidence led before it by the parties and would not be swayed away by the observations made in the impugned order.
