% 26.02.2016 Present writ petition has been filed with the following prayers :- "[A] quash and set-aside the impugned letter/order dated 20/10/2015 (ANNEXURE P-1) issued by respondent; [B] condone the delay of 127 days in filing the application for renewal of certificate of practise as Notary Public; [C] direct the respondent to pass a fresh orders on merits and in accordance with law on the application for renewal and subsequent letter/reply filed/submitted by petitioner and received by the respondent by following the provisions of Notaries Act and Rules framed thereunder, within a prescribed time limit;

Pass such other order/s as this Hon‟ble Court may deem fit and proper in the facts and circumstances of the case."

However, a perusal of the paper book reveals that an earlier writ petition seeking grant of Notary certificate was filed by the petitioner in the Bombay High Court. Once the jurisdiction of Bombay High Court had been invoked, this Court is of the opinion that it would be the convenient forum. This Court is also of the view that petitioner cannot indulge in 'cherrypicking'. Consequently, present writ petition is dismissed with liberty to petitioner to approach the Bombay High Court for aforesaid reliefs. However, this Court clarifies that it has not expressed any opinion on the merits of the case. Rights and contentions of all parties are left open. MANMOHAN, J FEBRUARY 26, 2016 rn
