At the very outset, learned counsel for the appellants seeks permission to apprise about a peculiar development. 2.

The present appeal has been filed assailing one order passed by the learned Trial Court under Order XXXIX Rule 1 and 2 read with Section 151 CPC. However, during further proceedings of the suit before learned Trial Court, such suit has already been withdrawn by the appellant on 23.04.2024 with permission to file a suit afresh. 3.

It is informed that pursuant to such permission granted by the learned Trial Court, a fresh suit has already been filed. 4.

It is quite obvious that in view of the above said peculiar development, the present petition has become infructuous. 5.

Accordingly, the present petition is, hereby, disposed of as having become infructuous.
