% 12.04.2018 Learned counsel for the petitioner submits that prosecutrix, who is aged about 28 years, along with her husband had cheated the petitioner and had taken `8 lacs from him on the pretext of sending him to Canada.
When the petitioner demanded his money back, prosecutrix has lodged this FIR. It is submitted that petitioner had given a complaint to the Superintendent of Police at Fatehpur Sahab (Punjab) on 12th August, 2017 stating therein that prosecutrix had threatened him that she would implicate him in a case under Section 376 Cr.P.C. in case he would demand `8 lacs from her. It is further submitted that FIR has been lodged on 14th December, 2017 with the allegations that petitioner raped her on 15th August, 2017 when the prosecutrix had accompanied the petitioner to Delhi from Chandigarh and they were staying at Diamond Hotel.
There is delay in lodging of FIR. Petitioner is in custody for the last about 4 months. Investigations are complete; charge sheet has been filed.
Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms.
