The complainant is not present today though the Investigating Officer (IO) who is present before this Court states that the complainant was duly informed about the date of hearing before this Court. 2.
This Court was informed that the victim is not appearing before the concerned Trial Court or in case she appears before the Court, she does not tender herself for deposition.

The record, however, reveals that she appeared before the court for the first time on 16.01.2024 when she was asked to. However, she stated that she was feeling unwell.

the date 08.02.2024 has been given at the convenience of the prosecutrix as well as counsel for the accused persons, therefore, it is expected that the prosecutrix and counsel for the accused persons will not seeking any adjournment.

Learned senior counsel for the accused/applicant, without prejudice to the rights and contentions of the applicant, seeks permission to withdraw the present bail application and states that the learned Trial Court may be directed to expedite the trial.

In view of the same, learned senior counsel for the petitioner seeks permission to withdraw the present bail application. 7.
Learned Trial Court is requested to expedite the trial and statement of victim is recorded on the next date of hearing. 8.
Accordingly, the present bail application stands dismissed as withdrawn.

It is clarified that withdrawal of the present bail application before this Court will not come in way of filing any future bail application before the learned Trial Court, which will be decided on its own merit, at an appropriate stage.
